The Supreme Court today allowed immediate arrests in dowry harassment cases under section 498A IPC.
A three-judge bench led by Chief Justice of India Dipak Mishra amended the Apex Court’s order in July 2017 and observed that the section 498A is being misused but it is not the Court’s duty to fill legislative gaps.
In 2017, a two-judge bench ordered the formation of Family Welfare Committees in each district which would verify the authenticity of dowry complaints. Police were able to conduct arrests only after they were given a green signal by the committees. Today’s amendment in the judgment would allow the police to conduct arrests under section 498A immediately.
